Terms of Service

This is a translation for convenience. The Japanese version is authoritative, and Japanese law governs.

These Terms govern your use of Livote, a realtime audience polling service for livestreams, operated by VirtualCross ("we"). By using the service you agree to these Terms.

1. Definitions

  1. "Broadcaster" means a user who registers an account and creates or runs events.
  2. "Viewer" means a user who joins a vote through a participation URL or QR code distributed by a Broadcaster.
  3. "Content" means the questions, options, images and other information a Broadcaster enters into the service.
  4. "Event" means a single poll created by a Broadcaster.

2. Accounts

  1. Broadcasters register through social login (Google or X). We do not store passwords.
  2. Broadcasters are responsible for safeguarding their social login credentials.
  3. We are not liable for losses arising from unauthorised use of an account, except in cases of our wilful misconduct or gross negligence.

3. Plans and payment

  1. The service offers a free plan and paid plans. The contents and price of each plan are shown on the pricing page and in the plan settings.
  2. Paid plans are charged by credit card (Stripe) at signup and automatically every month thereafter.
  3. The Business plan cannot be bought by card. It is an individual contract billed annually by invoice.
  4. You may cancel at any time. You keep the plan until the end of the current billing period; we do not issue pro-rated refunds.
  5. AI image credits (100 images for ¥1,500) can be purchased and used only on paid plans that include AI features. They are used after your monthly AI image allowance runs out, are valid for 365 days from the date of purchase, are used soonest-expiring first, and lapse when they expire. They cannot be used while you are on the Free plan (the expiry date keeps running) and are forfeited if you delete your account. Purchases are non-refundable.
  6. If payment cannot be confirmed, we may suspend paid features and apply free-plan limits.
  7. The free plan does not include technical support. Documentation only.

4. Concurrent participant limits

Each plan has a limit on the number of viewers who can take part in one event at the same time. The limit is shown on the pricing page. Once it is reached we stop accepting further participants and show viewers a "full" notice.

For events that include a rapid-tap question (where a viewer may vote repeatedly on the same question), the concurrent participant limit is half the usual figure.

5. Tickets

  1. Live streams (opening an event to viewers and accepting their votes) use tickets. On paid plans, one ticket covers a stream of up to 10,000 concurrent participants for 60 minutes. On the free plan, one ticket covers a stream of up to 50 concurrent participants for 30 minutes.
  2. Tickets are used when you start a live stream, when you extend it, and when you raise its participant limit mid-stream. Starting and extending use one ticket per 10,000 participants of the limit you choose (rounded up; one ticket on the free plan), and each extension moves the scheduled end back by one ticket’s length. The participant limit you choose cannot exceed your current plan’s participant limit. Raising the limit uses the additional tickets multiplied by the number of ticket lengths left before the scheduled end (rounded up).
  3. Before any ticket is used, we show how many will be used on a confirmation screen. Tickets used after that confirmation are not returned or refunded. If a stream could not start because of a fault on our side, the tickets used are returned automatically.
  4. Unless extended, a live stream ends automatically 10 minutes after its scheduled end time. A stream can be extended only before its scheduled end time.
  5. Each plan includes a monthly number of tickets, shown on the pricing page. Monthly tickets reset at 00:00 UTC on the 1st of each month (09:00 Japan time) and unused tickets do not carry over. Monthly tickets are used before purchased tickets.
  6. If you change plans mid-month, the monthly tickets available for the rest of that month are the new plan’s monthly number minus the tickets already used that month.
  7. On paid plans you can buy extra tickets at ¥1,200 each (up to 50 per purchase). They cannot be bought on the free plan. Purchased tickets are valid for 365 days from the date of purchase, are used soonest-expiring first, and lapse when they expire. Purchases cannot be cancelled or refunded, and purchased tickets are forfeited if you delete your account. If you move to the free plan, purchased tickets that have not expired can still be used, but each ticket then covers only what the free plan allows (up to 50 concurrent participants for 30 minutes).
  8. Rehearsals (streams for checking your setup before going live) are free and use no tickets. A rehearsal accepts up to 5 devices and accepts votes for up to 30 minutes from its start.

6. Content rights and responsibility

  1. Copyright and other rights in Content remain with the Broadcaster or the rightful owner.
  2. The Broadcaster grants us the right to use Content to the extent necessary to operate the service (delivering it to viewers and rendering it on the stream overlay).
  3. The Broadcaster warrants that its Content does not infringe the rights of third parties.
  4. For output produced by the AI design and image generation features, we make no warranty as to its content, its ownership, or that it does not infringe third-party rights. Whether to use such output is the Broadcaster’s decision and responsibility.

7. Prohibited conduct

You must not:

  1. violate any law or public policy;
  2. infringe the rights of third parties (copyright, trademark, likeness, privacy and so on);
  3. attempt unauthorised access or reverse engineering, or interfere with the operation of the service;
  4. falsify voting (automated multiple voting, evading device identification, tampering with tokens and so on);
  5. use viewer participation data obtained through the service for any purpose that breaches these Terms or the law;
  6. provide benefit to organised crime or engage in equivalent conduct.

8. Data retention and deletion

  1. Aggregated data for finished events is deleted after the retention period set by your plan. Retention periods are shown on the pricing page.
  2. Raw tap logs (who pressed which option and when) are kept only while the event is live and are deleted when it ends. They are never included in exports.
  3. Broadcasters may delete their account at any time. Deletion is immediate and cannot be undone.

9. Changes and interruptions

  1. We may change the service without prior notice, and may suspend it temporarily for maintenance, incidents or other unavoidable reasons.
  2. We may terminate all or part of the service with one month’s notice. In that case we refund any prepaid fees covering the period after termination.

10. Restrictions and account closure

If you breach these Terms we may, without prior notice, unpublish Content, restrict your use of the service, or suspend or delete your account.

11. Disclaimers

  1. We do not warrant that the service is free from defects in fact or in law. In particular, we do not warrant that the stream overlay will behave as intended on any specific broadcasting software, hardware or network.
  2. Where we are liable for loss caused by our fault, our liability is capped at the fees we received from you in the preceding three months, except in cases of our wilful misconduct or gross negligence.
  3. Disputes between a Broadcaster and a Viewer, or between users, are to be resolved between those parties. We are not a party to them.

12. Changes to these Terms

We may revise these Terms. Where a change is material we will announce it on the service or by other appropriate means. Continued use after a change constitutes acceptance of the revised Terms.

13. Governing law and jurisdiction

These Terms are governed by Japanese law. The Tokyo District Court has exclusive jurisdiction as the court of first instance for any dispute relating to the service.
